1. Introduction

Welcome to FotoVoto. We are committed to protecting your personal information and your right to privacy. This Privacy Policy explains what information we collect when you use the FotoVoto mobile application and related services (the "Service"), how we use it, who we share it with, how long we keep it, and the rights you have over it.

By using the Service you agree to this Policy. If you do not agree, please do not use the Service.

2. Information We Collect

2.1 Information you provide

  • Account information: email address, username, display name, password (stored as a one-way hash), date of birth, country, and language preference.
  • Profile information: avatar or profile photo and any details you add to your profile.
  • Third-party sign-in: when you sign in with Google, Apple, or Facebook, we receive your name, email, and a unique provider identifier. We never receive your third-party password.
  • User-generated content: questions you create, photos you upload, votes you cast, comments you post, and reports you submit about other users' content.
  • Age verification: your date of birth, used to confirm eligibility for age-restricted content.
  • Communications: messages you send to support, feedback, and survey responses.

2.2 Information collected automatically

Information we automatically collect:
  • Device data: device model, operating system and version, app version, language, time zone, and a randomly generated device identifier.
  • Usage data: features used, screens viewed, voting activity, session duration, and crash logs.
  • Network data: IP address, used for security and approximate location only.

2.3 Information from purchases

When you buy a vote pack through the Apple App Store or Google Play, we receive a transaction identifier, product identifier, purchase date, and entitlement state. We never receive or store your payment card, billing address, or App Store/Google account credentials: payment is handled entirely by Apple or Google.

2.4 Children

The Service is not directed to anyone under 17 and we do not knowingly collect information from children under 17. If you believe a child has provided us with information, contact support@fotovoto.app and we will delete it.

3. How We Use Your Information

We use the information we collect to:

  • Create, authenticate, and maintain your account.
  • Provide the core voting and content features of the Service.
  • Process in-app purchases and credit your account with vote packs.
  • Personalize your feed (categories, content filters, language).
  • Enforce age restrictions and content policies.
  • Detect, investigate, and prevent abuse, fraud, and Terms of Service violations, including review of user reports and blocks.
  • Send transactional notifications (account changes, OTP codes, purchase receipts).
  • Send promotional messages, only with your consent: you can opt out at any time.
  • Improve the Service through aggregated analytics and crash diagnostics.
  • Comply with legal obligations and respond to lawful requests.

Our legal bases for processing under GDPR are: performance of a contract with you, your consent (where required), our legitimate interests in operating and securing the Service, and compliance with legal obligations.

4. How We Share Your Information

We share information only when necessary, and we never sell it. We do not share personal information for cross-context behavioral advertising.

We share information with:

  • Service providers that help us operate the Service, under written data-processing agreements. These include providers of authentication, in-app purchase management, cloud hosting, content delivery, image storage, and security.
  • Apple and Google, when you make in-app purchases through the App Store or Google Play. They process your payment under their own privacy policies.
  • Law enforcement or regulators, when required by valid legal process or to protect the rights, property, or safety of FotoVoto, our users, or the public.
  • A successor entity, in the event of a merger, acquisition, or sale of assets, with notice to affected users.

5. Your Rights

Depending on your jurisdiction, you have the right to:

  • Access a copy of your personal information.
  • Correct inaccurate or incomplete information.
  • Delete your account and personal information. You can do this at any time directly in the app at Settings → Delete Account.
  • Restrict or object to certain processing.
  • Receive your data in a portable format.
  • Withdraw consent at any time, where processing is based on consent.

California Residents (CCPA/CPRA)

You additionally have the right to know, delete, correct, and limit use of sensitive personal information under the CCPA and CPRA. We do not sell or share your personal information.

EEA and UK Residents (GDPR)

You additionally have the right to lodge a complaint with your local data protection authority.

To exercise any right, email support@fotovoto.app. We will respond within 30 days, or sooner where required by law.

6. Data Retention

We retain your information only as long as necessary:

  • Account data: while your account is active, plus 30 days after deletion. Records related to purchases may be retained longer where required by tax or accounting law (up to 7 years).
  • User-generated content: while public; removed within 24 hours of a confirmed policy violation; deleted with your account.
  • Logs and diagnostic data: up to 90 days.
  • Reports of objectionable content: up to 12 months for pattern-of-abuse detection.

7. International Transfers

We are based in the United Kingdom. Your information may be transferred to and processed in countries other than your own, including the United States. Where required by law, we use Standard Contractual Clauses or equivalent safeguards.

8. Security

We use industry-standard safeguards, including TLS 1.2+ in transit, encryption at rest, hashed passwords, and encrypted token storage on device. No system is completely secure, and we cannot guarantee absolute security.

9. App Tracking on iOS

We do not track you across apps and websites owned by other companies, and we do not use Apple's advertising identifier (IDFA). If this changes, we will request your permission via the App Tracking Transparency prompt before doing so.

10. Changes to This Policy

We may update this Policy from time to time. Material changes will be announced in the app or by email at least 14 days before they take effect. Continued use of the Service after the effective date means you accept the updated Policy.
